These Terms & Conditions govern your access to and use of the Site, products, subscriptions, content, and services offered by PoolSide.
By accessing the Site, creating an account, purchasing products, subscribing to recurring deliveries, or otherwise using the Site, you agree to be bound by these Terms.

1. ELIGIBILITY
You must be at least twenty-one (21) years of age to access the Site, create an account, purchase products, or subscribe to services.
By using the Site, you represent and warrant that you are at least 21 years old.
2. IMPORTANT PRODUCT DISCLAIMER
PoolSide products are hemp-derived cannabinoid products intended solely for responsible adult use.
PoolSide products:
• Contain hemp-derived cannabinoids, including Delta-9 THC, in compliance with applicable federal law.
• Contain no more than 0.3% Delta-9 THC on a dry-weight basis.
• Have not been evaluated by the U.S. Food and Drug Administration (FDA).
• Are not intended to diagnose, treat, cure, or prevent any disease.
You are solely responsible for determining whether purchase, possession, transportation, or consumption of PoolSide products is lawful in your jurisdiction.
PoolSide reserves the right to refuse or cancel orders where shipment may violate applicable law.
3. HEALTH & SAFETY WARNINGS
PoolSide products contain THC and may cause intoxication or impairment.
Effects may be delayed and may vary from person to person.
Do not:
• Drive or operate machinery after consumption.
• Consume while pregnant or nursing.
• Consume if advised against cannabinoid use by a healthcare professional.
• Consume irresponsibly or in combination with other intoxicating substances.
Consumption of hemp-derived THC products may result in a positive drug test.
Keep products out of reach of children and pets.
4. ASSUMPTION OF RISK
By purchasing, possessing, or consuming PoolSide products, you voluntarily assume all risks associated with cannabinoid consumption, including:
• Delayed onset effects
• Overconsumption
• Individual sensitivity
• Allergic reactions
• Medication interactions
• Impairment
• Adverse physical or psychological reactions
You agree that PoolSide LLC, Moon Men LLC, and their affiliates shall not be liable for injuries, damages, losses, or claims arising from product use or misuse.
5. ACCOUNTS
Certain features of the Site may require account registration.
You agree to provide accurate and complete information and maintain the security of your login credentials.
You are responsible for all activity occurring under your account.
6. ORDERS, SUBSCRIPTIONS & PAYMENTS
All purchases are subject to availability, age verification, payment authorization, fraud review, and legal compliance.
PoolSide reserves the right to refuse, cancel, or limit any order at its sole discretion.
If you enroll in a subscription program, your subscription will automatically renew until canceled.
You authorize PoolSide and its payment processors to charge your selected payment method according to your subscription terms.
7. SHIPPING RESTRICTIONS
PoolSide ships only to locations where hemp-derived THC products are permitted by law.
We reserve the right to cancel or refuse shipments to any state, municipality, or jurisdiction where restrictions apply.
Customers are solely responsible for compliance with local laws.
8. RETURNS & REFUNDS
Due to the nature of consumable cannabinoid products, all sales are final unless otherwise required by law.
If your order arrives damaged, defective, or incorrect, contact info@drinkpoolside.com within seven (7) days of delivery.
PoolSide may offer replacement, refund, or store credit at its sole discretion.
9. INTELLECTUAL PROPERTY
All trademarks, logos, branding, product names, packaging designs, graphics, images, videos, text, and content on the Site are the exclusive property of PoolSide LLC or its licensors.
No content may be copied, reproduced, modified, distributed, or used without prior written consent.
10. USER GENERATED CONTENT
The Site may allow users to submit reviews, comments, testimonials, photographs, videos, feedback, and other content.
By submitting content, you represent that you own all rights necessary to share such content.
You grant PoolSide a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, display, publish, and otherwise utilize such content for marketing, promotional, and commercial purposes.
PoolSide reserves the right to remove content at its sole discretion.
11. ACCEPTABLE USE
You agree not to:
• Violate any law or regulation.
• Upload harmful code or malware.
• Interfere with Site operations.
• Attempt unauthorized access.
• Harvest user information.
• Submit fraudulent, abusive, offensive, or unlawful content.
PoolSide may suspend or terminate access for violations of these Terms.

PoolSide is not responsible for the content, services, privacy practices, or policies of third-party websites.
Use of third-party websites is at your own risk.
13. DISCLAIMER OF WARRANTIES
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLSIDE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
POOLSIDE DOES NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
14. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLSIDE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
IN NO EVENT SHALL POOLSIDE'S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
15. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless PoolSide LLC, Moon Men LLC, their affiliates, owners, officers, directors, employees, contractors, and agents from any claims, losses, liabilities, damages, costs, or expenses arising from:
• Your use of the Site
• Your purchase or consumption of products
• Your violation of these Terms
• Your violation of applicable laws
• Your infringement of third-party rights
16. COPYRIGHT COMPLAINTS (DMCA)
If you believe content on the Site infringes your copyright, please send a notice to:
Subject: DMCA Takedown Request
Your notice should include:
• Identification of the copyrighted work
• Identification of the allegedly infringing material
• Your contact information
• A good-faith statement regarding unauthorized use
• A statement under penalty of perjury that the information is accurate
PoolSide reserves the right to remove allegedly infringing content and terminate repeat infringers.
17. ARBITRATION AGREEMENT
Any dispute arising from these Terms, the Site, or PoolSide products shall be resolved through binding arbitration.
Arbitration shall occur in Broward County, Florida, under the rules of JAMS or a comparable arbitration provider selected by PoolSide.
The arbitrator's decision shall be final and binding.
18. WAIVER OF JURY TRIAL
YOU AND POOLSIDE WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING FROM THESE TERMS, THE SITE, OR ANY PRODUCT PURCHASE.
19. CLASS ACTION WAIVER
ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST POOLSIDE.
20. TERMINATION
PoolSide reserves the right to suspend, restrict, or terminate access to the Site, accounts, subscriptions, or services at any time without notice.
Any provisions that should reasonably survive termination shall survive termination.
21. CHANGES TO THESE TERMS
PoolSide may update these Terms at any time.
Updated versions will be posted on this page with a revised "Last Updated" date.
Continued use of the Site constitutes acceptance of the revised Terms.
22. GOVERNING LAW
These Terms shall be governed by the laws of the State of Florida.
Any disputes not subject to arbitration shall be resolved exclusively in the courts located in Broward County, Florida.
